Manusmiriti Dehn ( Burning) Diwas( Day) Remenbered 25-12-2019


Let us salute those who organised Manusmiriti Dehan, burnt Munusmiriti and witnessed this scene on its 92nd anniversary.

Ninety two  years ago today, that is, on December 25, 1927, Babasaheb Ambedkar burned Manusmriti as a symbol of rejection of the religious basis of untouchability.
Why it was thought to burn Manusmiriti
 Manusmititi is a Hindu Law book  which denies/denied all human rights to untouchable( Now called Scs, STs, OBCs)  and all women irrespective of her caste affiliations. The event was arranged during the Mahad SatyagrahaMahad Satyagraha was perhaps first fight world wide to exert right to take water from  public  water bodies by human who were classified as Hindus Shudras. It was also a fight of Untouchable to declare that they they will fightto gain humanity and dignity which was denied to them till then. For Babasaheb committed advocate for  untouchable and women’s rights and emancipation — it was a political action to burn  Manusmriti in full  public view as Baba Sahib was  convinced  that the book entailed the rules preaching inhumane treatment not only towards women but also “Untouchables”, in all walks of life both in  private or public spheres. It was clear revolt against Brahinism by their religious brothers untouchables.
The actual burning of Manusmiriti on 27th Decemember 1927 was joined among others by Saraswati Brahmin Gagadhar Neelkanth Sahasrabuddhe affectionately called as “Bapu” by his Ambedkarite admirers. He was a committed volunteer of the Samaj Samata Sangha founded by Dr. B.R.Ambedkar. He also served in the Social Service League as its chief. When Manusmriti was publicly burnt on 25th December 1927, at Mahad, Mr. Sahasrabuddhe alias Bapu Ji played very dedicated role along with many trusted lieutenants of Baba Saheb. R.K Kshirsagar in his book “Dalit Movement in India and its Leaders” writes that Gagadhar Neelkanth Sahasrabuddhe alias Bapu saheb was a Brahmin by caste, social worker and actually he burnt the Manusmiriti in full public view at Mahad where besides many others P.N. Rajbhoj, B.K. Giakward, Mr. Sitaram Shivtarkar and Dr. Ambedkar were present with their thousands of followers. Bapu Saheb Sahasrabuddhe was the Secretary of the Municipal Kamgar Sangha (Worker’s Union) led by Dr. Ambedkar. He served as the editor of the Janata till 1955. This fortnightly paper later weekly was initially started by Dr. Ambedkar on 24th November 1930 as a special tool to support and publicize policies and programs of Depressed Classes Movement. The weekly was later renamed as Prabhuddha Bharta on Dr Ambedkar’s directions on 4th February 1956. Another site (www.ambedkar.org) article “Manusmiriti Dahan Din” by Dr. K. Jamanadas has mentioned that a "vedi" was created beforehand to burn Manusmriti. Six people were labouring for two days to prepare it.
How the act was performed:
A pit six inches deep and one and half foot square was dug in, and filled with sandle wood pieces. On its four corners, poles were erected, bearing banners on three sides. Three sides Banners said,
1. "Manusmriti chi dahan bhumi", i.e. Crematorium for Manusmriti.
2. Destroy Untouchability and
3. Bury the Brahmanism.
On 25th December, 1927, at 9 p.m., the book of Manusmriti was kept on this and burned at the hands of BapuSaheb Sahastrabuddhe and another five six Dalit sadhus. At the meeting there was BabaSaheb's historical speech.
 The main points of speech: We have to understand why we are prevented from drinking water from this tank. He explained Chaturvarna, and declared that our struggle is to destroy the fetters of Chaturvarna; this was the starting point of the struggle for equality. He compared that meeting with the meeting of 24th Jan. 1789, when Loui XVI of France had called a meeting of French people’s representatives. This meeting killed king and queen, harassed and massacred the upper classes, remaining were banished, property of the rich was confiscated, and it started a fifteen year long civil war. People have not grasped the importance of this Revolution. This Revolution was the beginning of the prosperity of not only France but whole of Europe and has revolutionized the whole World. He explained French Revolution in detail. He then explained that our aim is not only to remove untouchabilty but to destroy chaturvarna, as the root cause lies there. He explained how Patricians deceived Plebeians in the name of religion. The root of untouchabilty lies in prohibition of inter-caste marriages, that we have to break, he thundered. He appealed to higher varnas to let this "Social Revolution" take place peacefully, discard the sastras, and accept the principle of justice, and he assured them peace from our side. After the Manusmriti was burned four resolutions were passed and a Declaration of Equality was pronounced. He further declared, that if unfortunately, this burning of Manusmriti does not result in destruction of "Brahmanya", we will have to either burn the "Brahmanya-grast" people (i.e. affected by Brahmanism), or renounce Hinduism.
Let each Dalit on this  historic day, the 25th December have self introspection whether he/she has adhered to the advice of their emancipator, if not why not.  They must evaluate the loss they have suffered for not following ideals of their liberator.They must think of correction in their actions so far ignored. Their emancipator Baba Sahib Dr. Ambedkar lost his kids, wife his life comforts for welfare of his people. He died under debit. They need to mend their ways for the good future of their generations. Let the Dalits know that till Baba’s written Constitution is alive they are alive. They should save it as their first religious act

Shouldn’t We Mend Now?


                                         
An old saying is “Wise men learn from folly of others and fools wait till they commit blunders themselves”. A Dogri proverb means “It is futile to repent folly when handcuffed; but to mend when free person to escape being handcuffing”. We give sermons and pieces of good advice to convince others to reform them selves. But we seldom think necessary to ponder over our own weaknesses to correct. Our ego makes us think that whatever “I” think is correct even if it may be miles away from the accepted correct path. Who cannot differentiate in the present day world between Right and Wrong? The simplest good behavior formula is to behave with others as you wish others to behave with you. Otherwise as we sow so shall we reap. Do we need a god man or mahatma to tell us every now and then that it is wrong to, lei, weigh less, over charge, abuse any body, harm an innocent creature, waste food, electricity, water, avoid corrupt means in one’s dealing, demand or snatch by deceit which belongs to others, over speed you vehicle, reach late to one’s office or work place, obey established law and norms etc. etc. Should we be reminded every day by a saint to behave as top of the creation else KAL, MOUT KA FRISHTA, DEVIL or negative power shall punish us after our death and put us in HELL. Even if a saint says so, how much does it affect our daily dealing after we move out of Satsang, Namaj, Kirtan, and Prayer Halls? Salvation lies in action not in only listening sermons. Baba Jaimal Singh (1839-1903) a Great Punjabi Mystic said “An ounce of practice is worth more than a ton of theory: How long we shall go on deceiving our selves. Let us try to be humans first then any thing else.  Since our Almighty God, our Devine Father resides with in human frame, so all human frames are equal and have Devine brotherhood relationship. Hence to Love His children or creation is to love God. Buley Shah a Great Sofi Saint proclaimed “RAB ASSAN TO BAKH NAHIN, PAR DEKHAN WALI AKH NAHIN” meaning God is with us always, but we do not have yet the Devine Eye to see Him. Our   lust, ego, worldly attachment, greed and anger, are the greatest hurdles on our way to right path leading away from our goal of attaining salvation. First we have to be Human before becoming God realization. For this we to control KAM (Lust) with chastity, KARODH (Anger) with tolerance, LOBH  (Greed) with contentment, MOH (Attachment) with detachment and AHNAKAR (Ego, Pride) with Humility or humbleness. Presently most of our actions do not make us qualify as humans. Leave aside our goal of Salvation or MUKTI   many of us do not qualify to be called as humans. Let us ponder over afresh on our actions and judge our selves how much we are concerned about ourselves and our fellow beings in our day to day worldly dealings.
          Driving: - Are we not responsible for over 4, 90, 383 (2012) Lakh  yearly accidents on Indian roads?. This resulted in death of 1, 38,258 (2012) persons with over 75% our youth. Is not driving with out helmets, with out proper driving licenses, over speeding, taking on Mobiles while driving, roaming animals on roads, improperly maintained vehicles, hurry, alcohol drinking while driving, continued use of vehicles beyond their  road worthiness age ,improper maintenance of roads, Rash driving, crisscrossing improper maintenance of vehicles. It has also been said that accidents on Indian roads are the most deadliness in the world. As per WHO India losses $20 billion annually enough to feed 50% of the nation's malnourished children. In J&K1366 got killed besides 10910 injured in 2006. If we responsibly behave on roads much of the loss on this account can be avoided.
      Quit Use of Tobacco: - Smoking induces many ill health problems. WHO estimated that Tobacco use kills at least 5 million people every year? Also second hand smoking kills about 600,000 people every year. Tobacco use is the leading preventable cause of death, so all should quit its use in all forms for his or her health safety.
     Corruption: - Corruption a world phenomenon is showing its ill effects on all spheres. It has assumed different shapes. Different scams from business house, Education, Army services, bureaucracy, politics, judiciary, police ,almost majority of  government supplies, medicines, medical equipment and many other departmental services and purchases. Professor Bibek Debroy and Laveesh Bhandari claim in their book Corruption in India: The DNA and RNA that the public officials in India may be cornering as much as Rs.921.22 billion ($18.42 billion), or 1.26 per cent of the GDP, through corruption. The book claims most bribery is in the transport industry, real estate and government delivered services.
Black Money:- A November 2010 report from the Washington-based Global Financial Integrity estimates that over a 60-year period, India lost US$213 billion in illicit financial flows beginning in 1948; adjusted for inflation, this is estimated to be 462 billion in 2010 dollars, or about $8 billion per year ($7 per capita per year). The report also estimated the size of India's underground economy at approximately US$640 billion at the end of 2008 or roughly 50% of the nation's GDP.                                                Black Money in Switzerland:-According to a 2010 The Hindu article, unofficial estimates indicate that Indians had over US$1456 billion in black money stored in Swiss banks (approximately USD 1.4 trillion) about 1.5% of India's GDP on average per annum basis.
Business and Corruption:- Public servants have very wide discretionary powers offering the opportunity to extort undue payments from companies and ordinary citizens. The awarding of public contracts is notoriously corrupt, especially at the state level. Scandals involving high-level politicians have highlighted the payment of kickbacks in the healthcare, IT and military sectors. The deterioration of the overall efficiency of the government, protection of property rights, ethics and corruption as well as undue influence on government and judicial decisions has resulted in a more difficult business environment.
Scams: - India lost incalculable amount in over 134 scams starting with one in 1948(Jeep scandal case)  increasing to 41 in2012. A number of scams involve nearly $1000 billions ( One billion is 1- lacs crores)
Bureaucracy:- Most of the largest sources of corruption in India are entitlement programmes and social spending schemes enacted by the Indian government. Examples include Mahatma Gandhi National Rural Employment Guarantee Act and National Rural Health Mission ,Public Distribution System, License Raj. Other daily sources of corruption include India's trucking industry which is forced to pay billions in bribes annually to numerous regulatory and police stops on its interstate highways. A study conducted by Transparency International in year 2005 found that more than 62% of Indians had firsthand experience of paying bribes or influence peddling to get jobs done in public offices successfully. Long time associate of Mahatama Gandhi and First Indian Governor –Gereral of India Chakravarthi Rajagopalachari (1878-1972) warned that License Raj was often at the core of corruption.
Crime infected Politics: - The Indian voting percentage has never exceeded 70% and no political party ever got 50% of  absolute votes. So all along India is being ruled by parties in minorities by political manupolations. As per latest reports2013 out of 543( Lok Sabha)  members 162(30%) have  declared criminal cases with 14% cases as serious crimes against them. The State Assembly members no way lack behind. Out of total strength of State Assembly members(MLA’s)1258(31%) of them have declared to facing criminal cases with 15% having serious natures cases against them. Out of total strength of Indian IAS officers 82% have stated that they faced political pressure with 63% saying the pressure was severe in nature.                                                                                                                                                Female feticide:- Female foeticide is a curse on the twenty first century. Though people are educated and well groomed but still they overlook the importance of female child. Pre-natal sex determination is done and hence the foetus is aborted if a girl child is found. The crime has the involvement of doctors, radiologist, gynecologists, nursing staff, young and old women and men, mostly affluent society. Natural balance between human sex ratio has been adversely effected. In some places the male, female ratio has declined to 888 females per 1000 males. As such its our duty to educate and make those stuck into social dogmas aware of this social sin. The prevailing laws must be made more strict and women must be given their due position in the society

Why creat controvercies for the permnently settled Nation Issues.


August 2019 news about sermons of Sh.Mohan Bhagwat RSS Chief suggesting dialogue between Anti and Pro Reservation supporters to settle this issue once for all. The RSS chief and final word to BJP Government in India has started a new topic on reservation by opening conversation between Pro and Anti Reservation groups in India. The reservation issue is well settled issue as per the Indian Constitution. It is not a temporary provision like Art.370 and 35-A now remoddled / removed by Reorganization Of J&K State Act of 2019. In making Art. 370 Dr. Ambedkar the father of Indian Constitution was first to oppose its inclusion. But the reservation issue which spouted from roots in the neglect and worst typed atrocities perpetuated on Untouchable (Now Dalits or SCs, STs, OBCs) by their religious superior brothers (Brahmins,Khatriyas,Vaisyas) for centuries. Before 1947 Independence on 26th July 1902 Chhaterpati Sahu Ji Mahraj the Emperor Of Kohlapur ordered 50% reservation in services for Backward Classes and also Raja of Pangal ( Ruled July 11,1921to Dec.3 1926), Madras Presidency ordered reservation for Back warded Classes in 1921. Official records show in 1902 in Kohlapur State 98% Ministers were Brahmin whose population was only 3% of the total population of the Kingdom.
While presenting the miserable conditions of Indian Dalits on 27 January 1919, Dr. Ambedkar submitted a memorandum and gave evidence before the Southborough Commission. He submitted glaring instances of neglect of his people due to prevailing untochability based hate. He submitted that in the whole Bombay Presidency there was one B.A. and 6 or 7 matriculates among the depressed classes. The proportion of those who were literate in English was very small, but not much smaller than in the case of the backward classes. He also cited a case in which a Mahar caste woman was taken to the police court for selling watermelons. The Dalits had faced worst during Peshwa Rule when every Dalit had to carry an earthed pot in his/her front to spit or nose blowing and a broom in the back to as to broom their foot marks on the ground so that do Brahminsmay not get polluted. This is only one narration of atrocities during Hay days of Hinduism from long list of such atrocities . The foreign invaders including Muslim, the British Rulers did not had courage to touch Hindu religious atrocities on unfortunate human body reduced to living skeletons of untouchable for fear of revolt from Brahmins as they were getting ministrial staff from them to run their rules. Then only Brahmins had education other were kept out of bound from this facility. These facts were explained by Dr. Ambedkar in all committees formed by the British crown from1909 onwards and also in 3 RTCs.
This Reservation for untouchables was recognized as minimum support in the form of reservation to these unfortunate human reduced to skeletons by Hindu Laws. The GOVT. Of India Acts of 1909, 1919, 1935 recognized the untouchables as a minority Separate from Hindus like Muslims, Sikhs, Christians, Anglo-Indians and Others. 3 RTC’s held in London where over 200 delegates including Mahatama Gandhi participated. Many of these delegates are now Bharat Ratna Awardees The Communal Award of 1932 and Poona Pact of 1932 had roots in granting safe guards to Untouchables in the future constitution of India. Finally in the Constitution of India settled permanently the reservation for untouchables in services and politics. The Constitution drafting body had 292 elected men of wisdom (193 Hindus & 33 from Reserved Castes) deliberated this matter for 2 years,11 months and 17 days while making the constitution for free India leaving no room for further discussion between the pro and anti reservation communities.
Keeping unity of India dear to his bosom and taking the worries of Hindus shown about welfare of untouchable in free India as real and gentlemanly promises Dr. Ambedkar compromised with Hindus rejecting demands of his own Dalit colleagues like Soami Achhutanand, Gaddar Party leader Mangu Ram Magowalia and many other for Achhutestan,an independent home land for untouchables. Had Dr. Ambedkar fallen in line with other Dalit leaders in demanding Achhutastan for Dalits population 12.36%( OBC population excluded) of India pre-partition population their share would have been roughly as 826698 sq. Km of united India on the analogy that Muslims with population share of about 15.39% got 102948 sq.km as Pakistan( East and West). In that case Dalits would have been standing as citizens of Independent country of their own. The Hindu leaders should keep in view the sacrifices Of Dalits in creation of United India, which now a largest democracy on the global map. Majority among 200 participants in 3 RTCs and,193 Hindu Members of Indian Constitution making besides Hindu signatories of POONA Pact are ancestors to many present day Caste Hindu leaders. If these present day caste Hindu leaders own assets created by their ancestors they have no right to dispute their wisdom in granting Reservation to Dalits and to shrink from owning the liabilities created by past Hindu leaders even if they think it a liability.
The present day Hindus leaders should reframe racking up the long settled issues like reservation in services and politics by their ancestors in the larger interests of the unity, fraternity and individual dignity. I will therefore impress upon the present day Hindu leaders to stand by the promises made by their elders. Hindu leaders should own assets and liabilities of yesteryears men of wisdom as per cannons of law established for, secular, democratic republic of Indian Constitution. If they try to create hurdles in execution of settled rules the Dalits will be free to think of their ways to safe guard their interests. Our Dalit ancestors have burnt Hindu Law Constitution book “Manusmriti” in 1925 giving a secular, Democratic Constitution to free India where individual Dignity and Fraternity besides equality before law are paramount. In a society a big brother is big till he behaves and does not force the younger to challenge his authority. His misbehaviour is sever beloe to errode his authority. Hope a good sense prevails in the minds of Caste Hindus to not disturb peace in the Country. They must reign some distructive minds among them who go on issuing unfounded statements and creating ill will among our countrymen. Mind you blind Bhagtas have always created more problems than solving any.

The Article 13 Of the Indian Constitution


The Article 13 Of the Indian Constitution is a powerful legal  provision where in all laws legally, religious enforceable prior to the adoption of the Constitution of free India were made inapplicable in India. Art.13 reads as
 Laws inconsistent with or in derogation of the fundamental rights
(1) All laws in force in the territory of India immediately before the commencement of this Constitution, in so far as they are inconsistent with the provisions of this Part, shall, to the extent of such inconsistency, be void ( Refers to laws existing prior to adopting this Constitution)
 Laws made after the commencement of the Constitution
(2) The State shall not make any law which takes away or abridges the rights conferred by this Part and any law made in contravention of this clause shall, to the extent of the contravention, be void
 This article 13 has now part 13(3),13(4) added by different amendments but these are to explain,  to enforce certain provisions of laws in certain circumstances..
 But the most powerful provision against the monopoly of religious laws or some other laws enacted for the convenience of the rulers was uprooted by the visionary wisdom of the Constitution framers. Baba Sahib Dr. Bhimrao Ramji Ambedkar the father of Indian Constitution got all unnatural Laws null and void by writing the Constitution and also getting consent of other members.
  Now the public utterances of some political Parties leaders, their Masters, Militant Armies          ( Senas)  maintained by some religions under the garb of social activities,  of change of Constitution, burning of the Constitution in full Public view in the presence of the  Government Law enforcing  agencies is all due to this Article 13 Provisions indigestion. Because uptill this article exits in the constitution no religious Laws of dividing people on the basis of caste, sex, colour place of birth can do any harm to Indian nationals who may be  penniless or Billionaire , sweeper or religious preacher. Dreaming of establishing Ram Rajya to assassinate SHABUKS  by certain people is not possible .
 So all right thinking Indian need to resist with their full force any change or scrapping of the Constitution by any person, political party, religious agencies etc.  Good of  Bharta lies in enforcing Constitutional provisions in letter and spirit.
